1. TradesMen OnLine website at www.tradesmenonline.com.au is independently owned and operated by Trade Services Online Pty Ltd (ACN 121 740 323) (“TradesMen OnLine”).

2. TradesMen OnLine website is primarily a referral forum for matching Customer job requests with tradesmen who may be able to fill those requirements.

3. Customers pay no fees to use the TradesMen OnLine website.

4. Tradesmen can register for a free listing providing basic contact information and can pay listing fees for membership and more extensive contact information.

5. These are the current terms and conditions relating to the agreement between you and TradesMen OnLine. The terms and conditions can be changed by TradesMen OnLine at any time.

6. It is important that all users of TradesMen OnLine.com.au understand and agree to our terms and conditions and you should contact us should you have any questions or require any clarification.

7. Your agreement and continued use of the TradesMen OnLine website indicates your acceptance of the current terms and conditions whether or not you choose to register with us or become a member.

8. TradesMen OnLine allows information to be placed on this website in good faith. You are solely responsible for the information that you post on this website or that you transmit to customers, tradesmen, registrants or members of TradesMen OnLine.

9. TradesMen OnLine does not guarantee the accuracy or reliability of any information displayed, upgraded or distributed through this website. You acknowledge that any reliance on such information is at your own risk.

10. TradesMen OnLine is not responsible for the conduct whether on line or off line of its customers, tradesmen, registrants and members.

11. TradesMen OnLine is not liable to you or anyone else for:-
(a) errors occurring in the information on this website;
(b) disruptions to this website; or
(c) interference with or damage to your computer system arising from the use of this website or an external website.

12. You agree to take your own precautions to ensure that information you use from this website is free of viruses or anything else that may interfere with or damage the operation of your computer system.

13. You agree:-
(a) not to use this website for any purpose that is unlawful or prohibited by these Terms and Conditions;

14. You agree to indemnify TradesMen OnLine against any loss suffered as a result of any actions or claims arising from:-

15. Subject to the above TradesMen OnLine’s liability to you for any cause whatsoever will be limited to the amount paid, if any by you to TradesMen OnLine.

16. In the event that you misuse this website or behave in a way which TradesMen OnLine regards as inappropriate, unlawful or illegal, TradesMen OnLine may:-
(a) investigate alleged misuse of this website;
(b) investigate alleged misbehaviour;
(c) terminate membership; and/or
(d) remove or block material published on this website.

17. You agreed that any dispute will be governed by the laws of New South Wales.

18. These terms and conditions contain the entire agreement between you and TradesMen OnLine regarding the use of this website. If any provision of this agreement is held invalid, the remainder of this agreement shall continue in full force and effect.

Customers

19. Customers agree that the information that they post on this website or provide to tradesman will be accurate and truthful and not harmful to any person in any way and that they are solely responsible for that information.

20. Customers agree that they will be solely responsible for investigating and verifying all information from this website upon which they intend to rely. TradesMen OnLine recommends that customers carry out all available searches and enquiries from government departments, trades organisations and referees.

21. Customers agree and acknowledge that TradesMen OnLine does not:-
(a) make any recommendation or give any guarantee regarding the information displayed or posted by tradesmen on this website;
(b) guarantee that customers will receive a response to their job requests; or
(c) guarantee any work carried out by tradesmen using this website and is not responsible for the nature and quality of such work.

Tradesmen

22. Tradesmen agree that:-
(a) all information posted by them on this website will be truthful and accurate;
(b) they hold necessary registrations and qualifications and have necessary experience to perform the works and provide the services listed by them on this website;
(c) they will quote on jobs in a timely manner;
(d) they will perform all work contracted with customers in a proper and workmanlike manner;
(e) they will obtain and maintain any necessary permissions and consents to use any professional logos, trademarks and intellectual property displayed or posted by them on this website;
(f) they will pay as and when they fall due all registration fees and other monies payable by them to TradesMen OnLine;
(g) they will keep their user name and password confidential; and
(h) they will advise of any security breaches.

23. Tradesmen agree that they will be solely responsible for investigating and verifying all information from this website upon which they intend to rely.

24. Tradesmen acknowledge that TradesMen OnLine does not guarantee:-
(a) the validity of customer enquiries or requests;
(b) that customers will respond to quotes given by tradesmen;
(c) payment for any work done by tradesmen for customers and is not responsible for such payment; or
(d) any priority or positioning of information posted on this website.
